Super Speeding in Florida

Florida's “Super Speeder” law went into effect on July 1, 2025, and, for the first time, makes excessive speeding without more a criminal offense in Florida. Previously, excessive speeding alone was not a criminal offense.

Under Florida Statute 316.1922, the crime of Super Speeding, formally designated Dangerous Excessive Speeding, occurs when a person drives a motor vehicle:

  1. 50 mph or more over the speed limit; or
  2. Over 100 mph in a manner that threatens the safety of others or interferes with the operation of another vehicle.

Under this definition, it is a strict liability crime to exceed any posted speed limit by 50 mph. Whereas driving over 100 mph requires evidence the safety of others was threatned or interfered with other drivers.

Penalties for Super Speeding

The penalties for the crime of Super Speeding increase based upon whether you have a prior Super Speeding conviction.

Depending on the circumstances of your case, Super Speeding in Florida can be charged as:

First Offense Dangerous Excessive Speeding

First offense Dangerous Excessive Speeding is a Second Degree Misdemeanor. If convicted of First Offense Dangerous Excessive Speeding, a judge can impose any combination of the following penalties:

  • Up to thirty (30) days in jail.
  • A fine up to $500.

Second Offense Super Speeding

Second Offense Super Speeding is a Second Degree Misdemeanor. If convicted of Second Offense Super Speeding, a judge can impose any combination of the following penalties:

  • Up to ninety (90) days in jail.
  • A fine up to $1,000.

A person convicted of a second or subsequent Super Speeding offense within 5 years after the last Super Speeding conviction will have their driver license revoked for at least 180 days but no more than 1 year.

Defenses to Super Speeding
